Terms of Service

Sly Tyler Real Estate is a real estate customer-communication program operated by JustCusto, LLC using the Sly Growth Agent platform ("Platform"). The Platform helps our licensed real estate team organize leads, research properties, draft outbound communications, coordinate follow-ups, and manage inbound email and SMS conversations sent under the Sly Tyler Real Estate name.

By creating an account or otherwise using the Platform, you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Platform.

The Platform uses artificial intelligence to generate drafts, summaries, property analyses, and recommendations. AI output can contain errors, omissions, outdated information, or content that is not appropriate for a given lead or situation. You are responsible for reviewing all AI-generated content before it is sent, published, or acted upon. AI output is provided as a starting point, not as a substitute for professional judgment.

The Platform is designed around a human-in-the-loop model. Outbound communications drafted with AI assistance require human review and explicit approval before they are sent. You agree not to disable, bypass, or misuse approval workflows, and you accept full responsibility for the content of any communication sent through the Platform under your account.

The Platform is a tool for licensed real estate professionals. Nothing produced by the Platform constitutes legal, tax, financial, or brokerage advice. You are solely responsible for compliance with all real estate laws and regulations applicable to you, including licensing requirements, advertising rules, fair housing laws, RESPA, MLS rules, and the rules of your brokerage. All communications sent through the Platform are your communications.

We do not guarantee any particular business outcome from using the Platform — including but not limited to leads generated, appointments booked, listings signed, transactions closed, or revenue earned. The Platform is a tool; results depend on your skill, effort, market conditions, and many other factors outside our control.

You agree not to use the Platform to:

• Send unsolicited marketing to recipients who have not consented, in violation of applicable law (including the TCPA, CAN-SPAM, and state analogs).
• Send content that is unlawful, harassing, defamatory, discriminatory, deceptive, or otherwise violates fair housing laws.
• Impersonate any person or entity or misrepresent your affiliation.
• Attempt to reverse engineer, probe, or interfere with the Platform's security controls or infrastructure.
• Scrape, resell, or redistribute Platform data or third-party data accessed through the Platform in violation of the source's terms.
• Upload malware or use the Platform to distribute prohibited content.

We reserve the right to suspend or terminate accounts that violate these rules.

You are responsible for the security of your account credentials and for all activity under your account. Use a strong password, do not share it, and notify us immediately at hello@slytyler.com if you suspect unauthorized access.

The Platform depends on third-party services including our managed database and authentication provider, Resend (email), Twilio (SMS), RentCast (property data), and AI model providers accessed through our hosted AI gateway. Your use of the Platform is also subject to the terms of these providers where they apply to end users. We are not responsible for third-party outages, changes, or errors, but we will work in good faith to minimize disruption.

SMS messaging through the Platform is optional and is subject to our SMS Terms and Privacy Policy. Recipients must expressly consent — through a checked opt-in, signed agreement, or documented verbal authorization — before any SMS is sent to them through the Platform. You are responsible for obtaining and documenting that consent, for honoring opt-outs across channels, and for complying with quiet-hours rules, message-content restrictions, and any A2P 10DLC registration requirements set by carriers.

The following program terms apply to every SMS sent through the Platform under the Sly Tyler Real Estate brand:

• SMS is optional; consumers are never required to receive text messages to use our services.
• Users expressly consent before receiving any messages.
• Message frequency varies.
• Message and data rates may apply.
• Reply STOP at any time to unsubscribe.
• Reply HELP at any time for assistance.
• Mobile information, phone numbers, SMS consent, and messaging data are NEVER shared, sold, rented, or disclosed to third parties or affiliates for marketing or promotional purposes.

Access to the Platform may be offered on a paid, trial, or invite-only basis. If fees apply to your account, they will be disclosed to you at signup or before billing. Fees are non-refundable except where required by law or expressly stated in a written agreement with us.

The Platform, including its software, design, and documentation, is owned by JustCusto, LLC and its licensors. You retain ownership of the lead data, property notes, and communication content you enter or generate. You grant us a limited license to host, process, and display that content solely to operate the Platform for you.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE, MERCHANTABILITY, AND NON-INFRINGEMENT.

IN NO EVENT WILL JUSTCUSTO, LLC, ITS OFFICERS, EMPLOYEES, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING OUT OF YOUR USE OF THE PLATFORM. OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE PLATFORM WILL NOT EXCEED THE FEES YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED U.S. DOLLARS ($100), WHICHEVER IS GREATER.

You agree to indemnify and hold harmless JustCusto, LLC from any claims, damages, or expenses (including reasonable attorneys' fees) arising out of your use of the Platform, your content, or your violation of these Terms or applicable law.

You may stop using the Platform at any time. We may suspend or terminate your access if you violate these Terms, if required by law, or if we discontinue the Platform. Provisions that by their nature should survive termination (including Sections 10–13, 15, and 16) will survive.

These Terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Platform will be brought exclusively in the state or federal courts located in Wyoming, and you consent to the jurisdiction and venue of those courts.

We may update these Terms from time to time. When we do, we will bump the version number and update the Last Updated date at the top of this page. Your continued use of the Platform after the effective date of the updated Terms constitutes acceptance of the changes.
